Halle Berry’s ex-husband Olivier Martinez was granted primary custody of their 12-year-old son, Maceo, following severe allegations of physical abuse against the Oscar-winning actress. A Los Angeles judge issued a temporary restraining order on Thursday, stripping Berry of her equal custody rights and ordering her to stay at least 100 yards away from Martinez. Under the temporary ruling, Berry is permitted daytime visits with Maceo twice a week alongside alternating weekends.

The explosive court order comes directly after Martinez alleged that Berry physically assaulted their son at her home on September 26. According to court filings obtained by Page Six, the dispute began when Berry verbally berated Maceo over a virtual reality video game. Martinez claimed the situation escalated rapidly when Berry allegedly jumped on the boy, grabbed his neck, and choked him while shouting, “Who is dominant now?!”

Following the alleged altercation, Maceo panicked and sent frantic text messages asking his father to pick him up immediately. Court documents included text records showing Maceo wrote, “Are u here please come,” while stating he was traumatized and refused to return to his mother’s house. Martinez further claimed in the court filings that Berry has engaged in a broader pattern of physical escalation, alleging she repeatedly wrestled Maceo to the ground and forced him to tap out over the past 18 months.
Berry forcefully denied all accusations through her legal representation, characterizing the court filings as completely baseless. Attorney Marina Beck issued a statement calling the allegations entirely meritless and deliberately misleading, while pointing to Martinez’s own past judicial sanctions and alleged history of possessive and violent behavior. Beck asserted that Berry remains deeply saddened by the claims but will continue fighting for Maceo’s best interests in court.

The court filing also detailed accusations regarding the former couple’s protracted financial disputes, which stem from their 2015 split after two years of marriage. Martinez alleged Berry made racially charged remarks directly to Maceo concerning their court-ordered child support, where Berry pays $8,000 monthly plus additional income royalties. The bitter divorce took eight years to finalize, and both parties are ordered to appear back in court for their next hearing on October 16.
